WHAT:
An examination required to practice in front of the USPTO (United States Patent and Trademark Office).
The cost for the exam including all fees is $240.

WHO CAN TAKE THE EXAM:
Applicant must have a bachelor’s degree in a recognized technical subject (e.g. engineering, biology,
chemistry, physics, etc.). For more information consult the “General Requirements Bulletin” on the USPTO
website at: http://www.uspto.gov/web/offices/dcom/olia/oed/examregist.htm - page 3.

WHEN:
The exam is offered within a 90-day window of when your registration is complete. Consult the latest “General
Requirements Bulletin” for details. Keep in mind that the USPTO needs to receive all materials to register –
this includes your undergraduate transcripts, application and payment.

WHERE:
The exam is now administered commercially by Prometric. A listing of test sites can be found at -
http://www.prometric.com/Default.htm .

WHY:
The passage of this exam may be of some help when trying to procure a clerkship and/or summer associate
position in the patent law field. If you choose to practice patent law, you will need to take this exam before you
are able to practice in front of the USPTO. Upon passage of the exam (while still in school), you will be listed
as a patent agent and will be able to practice in front of the USPTO for life. Your name will be listed on the
USPTO website as a patent agent until you pass a state bar exam.
