Issues of copyright apply differently to each type of reserves:
Hard Copy Reserves - If the item is owned by the University Libraries or it is a personal copy, than there are no copyright restrictions when placing it hard copy reserve.
Electronic Reserves - Section 107 of the U.S. Copyright Act allows for an article or book chapter to be used for one semester without seeking the permission from the rightsholder; however, the scope of the material must be within fair use guidelines. To use an article or chapter for subsequent semesters, the library will seek permission from the rightsholder. While seeking permission, the item may remain on reserve; however, if permission is denied, the item will need to be removed from reserve.
Media Reserves - If the item is owned by the University Libraries or it is a personal copy, than there are no copyright restrictions when placing it media reserve. Compilation CDs or DVD created by instructors will need to be evaluated for their compliance with copyright law.
