40-01 Campus Conduct

Violators may be ejected from University property; subject to criminal prosecution and/or university discipline; University authorized to take action under Ohio Revised Code Section 3345.21 to preserve good order and prevent the disruption of the educational functions of the University.

41-01 Disciplinary Power of the University

Standards of conduct apply to a student of University property; student is expected to abide by applicable federal, state and local laws; University assesses penalties for violation of its own regulations; student is subject to public laws which UAPD is empowered to enforce of University property; Public laws; Ohio Revised Code; City of Akron Ordinances; regulations relating to disorderly conduct, theft, assault, arson, damaging property, sex offenses, the use of drugs, hazing and mob action.

41-02 Definition of Student Misconduct

Behavior on University property that violates codified or explicitly stated University rules or regulations; Plagiarism, cheating and other forms of academic dishonesty; false or misleading information to University officials or on official University records, or altering such records; detaining, holding, intimidating, injuring or threatening injury to any person lawfully upon University property; theft, malicious destruction, damage or injury to property not personally owned; possession, use or distribution of any drug prohibited by law; unauthorized consumption, possession, or distribution of alcoholic beverages; gambling or games of chance, illegal or unauthorized possession of weapons or explosives; felonies and misdemeanors; unauthorized entry into University facilities; obstruction, disruption, or occupation of space that impedes implementation of authorized programs and functions of the University; violation of University regulations prohibiting animals on University property; mischievous behavior on the computer or any other wrongful use of a computer; doing any act or coercing another to do any act of initiation that causes or creates a substantial risk of causing mental or physical harm to any person; failure to comply with directions of University administrative officers and police or any other governmental law enforcement officers upholding University regulations.

41-03 Investigation of Student Misconduct

Fact-finding procedures; notice to student to come to the Office of the Dean of Student Services; informed of the report that alleges violation of University rules and regulations; requested to make a statement; student informed, not required to make a statement, any statement may later be used in disciplinary proceedings, and right to counsel; proceed carefullly but informally whenever possible; termination of fact-finding procedures when based on the evidence presented, no University rule or regulation was violated and the student denies the alleged misconduct.
Probable cause; opportunity to explain involvement; detailed written report to Dean of Student Services for transmission to the University Hearing Board (UHB); request in writing that the case be heard, and the penalty assessed in a confidential session.
If referred to the UHB; UHB will meet at a date not to exceed thirty days from the date of the conference; general description of the charges; Dean of Student Services will notify the student of the time and place of the hearing, the violation and the facts surrounding the incident; failure to respond to the summons.

41-04 Student Procedural Rights

Protect the student from unfair imposition of serious penalties; procedural rights for which the penalty of formal disciplinary probation, suspension, or dismissal may be prescribed; penalties imposed must bear a reasonable relationship to the violation; in cases involving suspicion of misconduct student premises and possessions shall not be searched unless appropriate authorization has been secured nad probable cause shown; inform students of their rights; respect the right of the individual to refuse to testify against himself; pending action on the charges, the status of the student shall not be altered.
University may suspend a student immediately in some circumstances; safty and well-being of students, faculty or staff is endangered; felonies and misdemeanors; unauthorized entry into or use of University Facilities; obstruction or occupation of space that impedes the implementation of authorized programs and functions of the University; detaining, holding, intimidating, injuring, or threatening to injur or coerce a person lawfully upon University property; failure to comply with directions of University personnel or any other governmental law enforcement officers actin in the performance of their duties.
Notice to give the student an opportunity to prepare for the hearing; right to an advisor in anticipation of a criminal trial; student speaks and acts on his or her own behalf; objections by the advisor; recess; Hearing Board may request advice from a University attorney.
University Hearing Board; two faculty members and two students; conduct the hearing as a counseling-type interview; refusal to appear before the Hearing Board then the student may be tried in absentia and penalty imposed in accordance with the findings.
Student may plead guilty; also has the right to have innocence or guilt determined by the University Hearing Board; burden of proof on the University.
Fair and impartial hearing; no member of the University Hearing Board shall be a party to the prior investigation of the case against the student; standard of substantial evidence; report of the University Hearing Board; student's right of appeal to the Review Board.

41-05 University Hearing Board

Composition; two faculty members appointed by the Vice President of the University and Dean of Student Services; two student members appointed by the Dean of Student Services; student members recommended by a majority vote of the Associated Student Government; each Hearing Board selects its own presiding member; accused student has the right to challenge any member for good cause.
Proccedures; immediately notify student suspected of misconduct; UHB has the authority to call upon any student or faculty member who might have pertinent information; opportunity to hear and question adverse witnesses; presiding member shall prevent abusiveness, require normal discretionary controls, require relevance, and ensure the expeditious pursuit of information; accused is not required to testify against herself or himself; guilt and penalty decided by a majority vote; hearings are confidential unless the accused requests public or open hearings; student's right of appeal to the Review Board.

41-06 University Appeals Board

Composition; three faculty members and two student members; Procedures; hears all cases upon the request of the accused student; seven days from notification of the University Hearing Board's decision to petition the Appeals Board for review; penalty held in abeyance pending appeal; appeal must be in writing and set forth the grounds for appeal; written request for appeal goes to the Associate Vice President and Dean of Student Life; Grounds for appeal; Standards of review.

41-07 Presidential review.

Upon request to President by Vice President for Student Affairs; may uphold or reverse hearing board or appeals board finding; may uphold, increase or decrease sanction; decision is final.

41-08 Authority for Amendments

Board of Trustees may be approached with proposed changes and amendments through channels outlined in its bylaws.

42-01 Student Rights and Responsibilities

Preamble; academic freedom; responsibility of preserving the freedom of others and working for the good of the entire community.
Access to education; open to all applicants who meet admission requirements; no applicant denied admission on the basis of age, race, creed, sex, national origin or political beliefs; by enrolling the student signifies willingness to adhere to University rules and regulations.
