We believe that The University of Akron must maintain a living and learning environment that is inclusive in that it respects all aspects of diversity, promotes tolerance, and is free from intimidation or harassment. To that end, the University will further its commitment to inclusive excellence and investigate allegations or suspicions of hateful, threatening or otherwise intimidating or harassing actions that threaten these goals for a positive living and learning community.

After Dr. Proenza and I first became aware of the recent rock-painting incident on Monday evening, we contacted the adviser of Black United Students then arranged to meet with the student leaders of that group. We also contacted the University’s police department to confirm that a thorough investigation was underway. We met with BUS leaders yesterday to listen to their concerns, to update them on the investigation, and to begin planning activities to encourage campus dialogue about the issues raised by this incident.

Later on Tuesday, four students came forward and admitted to having painted the Spirit Rock late one night during the weekend without regard for the current art on the rock, independently apologizing and denying any motivation beyond wanting to paint their group’s nickname and shocking graffiti on the rock. The University police interviewed each of the students separately and, today, met with members of the City of Akron Prosecutor’s Office to review all evidence and reports and to determine what criminal charges should be pursued. The prosecutors determined that there is no basis to proceed with a criminal prosecution as a “hate crime” (Ethnic Intimidation) or any subordinate offenses such as Aggravated Menacing, Menacing, Criminal Damaging or Criminal Mischief. Accordingly, the University will refer the matter to the student judicial system for appropriate disciplinary review.

The leadership of BUS, Associated Student Government, the Office of Multicultural Development, United Black Forum, Diversity Council, the Institute for Teaching and Learning, Student Affairs and others have stepped forward to offer their assistance, expertise and participation in the development of an open and constructive dialogue about the imperative for tolerance. We are grateful for their leadership and involvement, and we look forward to our collective good works aimed at improving our campus climate and ensuring that respect for all and inclusive excellence are the values that our community embraces.

The University of Akron's Zipmail is a compilation of University announcements for University students, sent each Friday unless circumstances require otherwise. The deadline for submissions to be considered by the University is 5:00 p.m. on Wednesday.

Zipmail is a University of Akron communication vehicle established for the benefit of The University of Akron to communicate with its students. Items will be accepted for publication only when the University is directly involved in the activity through participation, sponsorship, or partnership with one of its recognized organizations, colleges or departments. The University reserves the right to edit or to refuse to run any submission for any reason. Zipmail is not, nor is it intended to be, a public forum or a limited public forum. Questions about the implementation of this policy may be directed to zipmail@uakron.edu.

Items to be considered for inclusion in Zipmail should be sent through the Zipmail Event Submission Form. Due to the volume of submissions received, items will not run more than one time.
